"The seller does not respect the warranty"

I bought radios from this seller on ebay, he urged me to cancel the auction and buy through his site, it seemed much less safe to me so I didn't. The items came after almost a month and unfortunately the battery did not charge. I wanted to replace it under warranty but the seller said that he would not give me a warranty for the purchased. I bought items as new, the seller seemed to be registered, no invoice was attached to the purchased items.
