"Unfair Return Policy"

I made a recent purchase of Tranquility DayTime Underwear. On arrival the products were not as advertised ,or the proper size.
I had purcased 2 boxes to obtain the free shipping offer for orders more than $40.. I was informed that I could NOT retrn the opened box,and muat pay$13. to ship back the second.
How is it possible to exam the product wihout opening the package ?
Why such a ridiculous and unfair return policy?
